Registered office: 27 Old Gloucester Street, London, WC1N 3AX, United Kingdom
These Terms of Use ("Terms") govern your access to and use of the Luvio website at www.luvio.club, the Luvio mobile applications, and all related features and services (together, the "Service"). The Service is operated by LUVIO TECH LTD ("Luvio", "we", "us" or "our").
Please read these Terms carefully. By creating an account, making a purchase, or otherwise accessing or using the Service, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Service. These Terms should be read together with our Privacy Policy, Cookie Policy and Refund & Cancellation Policy, each of which is incorporated by reference.
1. Who we are and how to contact us
The Service is provided by LUVIO TECH LTD, a company registered in England & Wales under company number 17115334, with its registered office at 27 Old Gloucester Street, London, WC1N 3AX, United Kingdom.
Contact: You can contact us at support@luvio.club. This is also our customer-service contact for questions, complaints, cancellations and refund requests.
2. About these Terms and changes
These Terms form a legally binding agreement between you and Luvio. We may update these Terms from time to time (for example, to reflect changes in our Service or in the law). The "Last updated" date at the top shows when they were last changed. Where changes are material, we will take reasonable steps to notify you, for example by email or in-app notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
3. Eligibility and prohibited jurisdictions
Minimum age. The Service is strictly for adults. You must be at least 18 years old (or the age of majority in your country, if higher) to create an account or use the Service. We do not knowingly allow anyone under 18 to use the Service.
Capacity. By using the Service you confirm that you have the legal capacity to enter into these Terms and that all information you provide is accurate and truthful.
Sanctions and restricted territories. The Service is not offered to, and you may not use it if you are located in or ordinarily resident in, any country or territory subject to comprehensive sanctions under applicable United Kingdom, European Union, United Nations or United States laws, or any jurisdiction where the Service is otherwise prohibited by law. You confirm that you are not located in such a territory and are not a person with whom dealings are restricted under applicable sanctions or export-control laws.
4. Your account
To use most features you must create an account. You agree to provide accurate, current and complete information and to keep it up to date. You are responsible for keeping your login details confidential and for all activity that takes place under your account. You may hold only one account. Notify us immediately at the contact address above if you believe your account has been accessed without your permission.
We may offer optional identity or photo verification to help keep the community safe. Where you choose to verify, you agree that the information you submit is genuine and relates to you.
5. Acceptable use and prohibited conduct
You agree to use the Service lawfully, respectfully and only for its intended purpose of meeting and connecting with other adults. You must not:
impersonate any person or misrepresent your identity, age or affiliation;
post or share content that is unlawful, defamatory, hateful, harassing, threatening, sexually exploitative, or that depicts violence or illegal activity;
solicit money from, scam, defraud or deceive other members, or use the Service for prostitution, trafficking or any commercial sexual service;
post content involving anyone under 18, or sexualise minors in any way;
harvest or collect other members' data, send spam, or use bots, scrapers or other automated means without our permission;
attempt to interfere with, compromise or circumvent the security or proper working of the Service;
use the Service to advertise, recruit or promote third-party products or services without our written consent.
We may investigate and take action (including content removal, suspension or termination, and reporting to authorities) where we reasonably believe these Terms have been breached.
6. Content you provide and licence to us
You retain ownership of the photos, text and other content you submit ('User Content'). By submitting User Content you grant Luvio a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt and display that content for the purpose of operating, providing and promoting the Service, for as long as you keep it on the Service and for a reasonable period afterwards to the extent needed for backups, moderation and legal compliance.
You confirm that you own or have the necessary rights to your User Content and that it does not infringe the rights of others or break any law. We may, but are not obliged to, review, moderate or remove User Content.
7. Safety and interactions with other members
Luvio provides a platform for members to connect, but we do not conduct criminal background checks on members and we are not responsible for the conduct of any member, online or offline. You are solely responsible for your interactions with others. Please use common sense, follow our Safety Guidelines, keep personal and financial information private, and meet in safe, public places. If someone asks you for money or behaves suspiciously, do not send funds and report them to us.
8. Our intellectual property
The Service, including its software, design, text, graphics, logos and the 'Luvio' brand, is owned by or licensed to Luvio and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for your own non-commercial use in accordance with these Terms. You may not copy, modify, distribute, reverse engineer or create derivative works from any part of the Service except as permitted by law.
9. Pricing, taxes and currencies
Prices. Prices for premium subscriptions, account upgrades, boosts, super likes, virtual gifts and other paid features are shown at the point of purchase. We may change prices from time to time, but changes will not affect purchases you have already made.
Currencies. Prices are displayed and charged in pounds sterling (GBP), euros (EUR) or US dollars (USD), as shown at checkout for your location. The currency that applies to your purchase is confirmed before you pay.
Taxes. Prices include value added tax (VAT) or other applicable sales taxes where required; the applicable tax is reflected in the price shown at checkout. You are responsible for any other taxes that may apply to you.
10. Subscriptions and automatic renewal
Some features are offered on a subscription basis. When you buy a subscription, you authorise us and our payment providers to charge the subscription fee on a recurring basis - at the billing frequency and price shown at the point of purchase (for example, monthly, every three months, every six months, or annually) - until you cancel.
Renewal terms. The renewal price and billing frequency are displayed before you buy and confirmed in your purchase confirmation. Subscriptions renew automatically at the end of each billing period at the then-current price for that plan unless you cancel beforehand.
Annual reminders. For annual (yearly) subscriptions, we will send you a reminder by email at least 30 days before each automatic renewal.
Cancelling. You can cancel at any time through your Luvio account settings, or, if you subscribed through an app store, through that store's subscription settings. Cancellation stops the next renewal and takes effect at the end of your current paid period; you keep access until then. Except where the law requires otherwise, fees already paid for the current period are non-refundable. See our Refund & Cancellation Policy for details.
11. Virtual items and digital content
Boosts, super likes, virtual gifts, in-app credits and similar items ('Virtual Items') are a limited, personal, non-transferable, revocable licence to use a feature of the Service. Virtual Items have no monetary value, cannot be exchanged for cash, and cannot be transferred or resold. Once a Virtual Item has been used or applied, it is consumed and is non-refundable except where required by law. We may manage, change or discontinue Virtual Items, subject to your statutory rights.
12. Delivery of digital products and services
Luvio provides digital products and services only. There is no physical shipment, and no delivery or shipping fees apply. Access to a purchased subscription, upgrade or Virtual Item is delivered electronically and activated on your Luvio account immediately after your payment is successfully authorised, and in any event without undue delay. If a purchase is not applied to your account, contact us at the address above and we will resolve it or refund you in line with our Refund & Cancellation Policy.
13. Payments and payment security
Payments are processed by third-party payment service providers that are certified PCI-DSS compliant. We do not collect or store your full card number or other raw cardholder data on our own systems; your card details are entered and handled within the secure environment of our payment providers.
Card transactions are additionally protected by 3D Secure authentication (Visa Secure / Mastercard Identity Check) where supported by your card issuer. By submitting a payment, you confirm that you are authorised to use the chosen payment method.
14. Your right to cancel and refunds
If you are a consumer in the UK or EU, you may have a statutory right to cancel certain purchases within 14 days. Because our products are digital content and services supplied immediately, this right can be lost once supply has begun with your consent. Your rights, the exceptions, and how refunds are processed are explained in full in our Refund & Cancellation Policy, which forms part of these Terms. Nothing in these Terms affects your non-waivable statutory rights.
15. Chargebacks and payment disputes
If you believe a charge is incorrect or unauthorised, please contact us first at the address above so we can investigate and, where appropriate, issue a refund - this is usually the quickest way to resolve a problem. Initiating a chargeback or payment dispute with your bank for a charge that was valid (for example, for a service you used or a Virtual Item you consumed) may be treated as a breach of these Terms, and we reserve the right to suspend or close the relevant account and to contest the dispute with supporting evidence.
16. Suspension and termination
You may stop using the Service and delete your account at any time through your account settings. We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to do so by law, or to protect the Service or other members. On termination, the licences granted to you end; clauses that by their nature should survive (including those on intellectual property, liability, payments already due, and governing law) will continue to apply.
17. Disclaimers
The Service is provided on an 'as available' basis. While we work to keep it running smoothly, we do not guarantee that it will always be uninterrupted, error-free or secure, that any particular match or outcome will result, or that other members' information is accurate. To the fullest extent permitted by law, we exclude implied warranties that are not required to be given to you as a consumer.
18. Our liability to you
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for losses that were not reasonably foreseeable, for losses arising from the acts or conduct of other members, or for business losses. Where we are found liable to you, our total liability arising out of or in connection with the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or GBP 100. Nothing in this clause affects your statutory rights as a consumer.
19. Your indemnity to us
If you use the Service in breach of these Terms or unlawfully, you agree to be responsible for the reasonable, foreseeable losses, costs and claims that we suffer as a direct result, except to the extent they are caused by our own breach or negligence.
20. Privacy and data protection
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and, where applicable, the EU GDPR. Our Privacy Policy explains what we collect, how we use it, and your rights. Please read it carefully.
21. App stores and third-party services
If you download our app or make purchases through the Apple App Store or Google Play, the relevant store's terms also apply, and purchases and refunds made through a store are subject to that store's rules. The Service may link to or rely on third-party services; we are not responsible for third-party content or services, which are governed by their own terms.
22. Complaints and dispute resolution
We aim to resolve complaints quickly and fairly. Please contact us first at support@luvio.club and we will do our best to put things right. If you are a consumer in the EU and we cannot resolve your complaint, you may use the European Commission's Online Dispute Resolution platform. Using these options does not affect your right to bring legal proceedings.
23. Changes to the Service
We may update, change or withdraw features of the Service to improve it, for security, or for legal reasons. Where a change materially reduces a paid feature you have purchased, we will act reasonably and in accordance with your statutory rights.
24. Governing law and jurisdiction
These Terms and any dispute arising out of them or the Service are governed by the laws of England and Wales. You and we agree that the courts of England and Wales have jurisdiction, except that if you are a consumer resident elsewhere in the UK or in the EU, you may also bring proceedings in, and benefit from the mandatory consumer-protection laws of, your country of residence.
25. General
These Terms (together with the policies they incorporate) are the entire agreement between you and us regarding the Service. If any provision is found to be unenforceable, the rest will continue to apply. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours, for example as part of a business sale, provided your rights are not adversely affected.
